Delwayne Denny of Box Elder, 30-years-old, was sentenced in federal court in Great Falls on May 10th to 85 months in prison and 10 years of supervised release after pleading guilty to sexual abuse.
In an Offer of Proof filed by Assistant U.S. Attorney Danna Jackson, the government stated it would have proved at trial the following:
On March 11, 2012, Denny, along with three other adults, returned to a house located on the Rocky Boy's Indian Reservation.
The victim, who was very intoxicated, was taken into one of the bedrooms, by two concerned teenage boys, to "sleep it off."
At some point in the evening Denny went into the bedroom and engaged in sexual intercourse with the victim, even though she was passed out.
The victim regained consciousness and demanded that Denny stop having sex with her. The victim grabbed clothes and left the house to look for help.
Law enforcement had been called by a neighbor. Law enforcement found the victim in the fetal position in the middle of the roadway, crying hysterically.
The victim was transported to the emergency room in Havre and consented to a sexual assault exam.
