MISSOULA - Leo Henry Green, an 18-year old high school student, is facing a felony charge of sexual intercourse without consent after allegedly having a "threesome" with his girlfriend and a 13-year-old girl.

The alleged incident happened early Saturday morning at the University of Montana off-campus housing.

When police responded to an apartment on Laurin Court for a report of a fight, Green's girlfriend told officers that Green had sex with the 13-year-old girl.

Officers found the 13-year-old sleeping in a car near the apartment.

When police interviewed her, she told them she was drinking and agreed to have a threesome with Green and his girlfriend.

She said that at some point Green's girlfriend became jealous and started fighting with Green.

Green admitted having sex with the 13-year-old, but told investigators that he thought she was 14 or 15.

The judge set bail for Green at $75,000.
