Indian Leider, a 20-year-old resident of Rocky Boy, was sentenced in federal court in Great Falls on Tuesday to 16 months in prison and five years of supervised release after pleading guilty to sexual abuse of a minor.
A press release from the U.S. Attorney's office states that in an Offer of Proof filed by Assistant U.S. Attorney Danna R. Jackson, the government stated it would have proved at trial the following:
On January 27, 2012, Leider was at a house party located on the Rocky Boy's Indian reservation. Also at the party were under-aged girls. Leider has sex with a girl who was thirteen. The girl was drinking and had reported to a medical provider that she "blanked out."
Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that Leider will likely serve all of the time imposed by the court. In the federal system, Leider does have the opportunity to earn a sentence reduction for "good behavior," but any such reduction will not exceed 15% of the overall sentence.
The investigation was conducted by a cooperative effort between the Federal Bureau of Investigation, the Rocky Boy Law Enforcement and Chippewa Cree Law Enforcement.
