A Helena man's request to sell medical marijuana just outside Great Falls city limits has been denied again.
All five members of the Cascade County Zoning Board of Adjustment voted to deny the appeal.
An earlier decision by the Cascade County Planning Department forbid Joshua Schultz from selling the drug at his
business site on Stuckey Road.
Schultz told the board he chose the area due to its remote location, but the county says the site is in a business zone, rather than an industrial zone, and the distribution of medical marijuana is prohibited in that region.
Schultz's attorney Carl DeBelly said, "While we can understand their fear of the unknown, it is a decision that we believe isn't rationally made and we're disappointed."
Susan Conell, Cascade County interim planning director, explained, "The bottom line is today was not about our opinion on medical marijuana, but rather than today's rules don't allow it in a B Zone district."
DeBelly says Schultz will consider making an appeal in district court.
