Eastern Montana man arrested in death of Kalispell woman

An Eastern Montana man has been arrested and charged with the death of a Kalispell woman more than two years after she disappeared.

Cody Wayne Johnston of Richland County is charged with deliberate homicide and tampering with physical evidence in the death of his girlfriend 31-year-old Nicole Waller of Kalispell.

Johnston was arrested Monday afternoon in Sidney.

Waller's family first reported her missing in February 2013 after she didn't return from visiting Johnston in Fairview. Law Enforcement later found Waller's vehicle abandoned on Highway 2, near Poplar.

In interviews with law enforcement, Johnston said he met Waller at a Kalispell high school and then the two later reconnected on Facebook and began dating soon after.

According to court documents, Waller and Johnston fought about their relationship on February 13, 2013, and she left for Kalispell the following day. The was the last time anyone heard from Waller.

Phone records show Johnston deactivated Waller's cell phone, which he was paying for, then he turned off his phone for about three hours.

Authorities say they believe this is when Johnston disposed of Waller's body. Waller's body has not been recovered.

Johnston is expected to make his initial appearance in Richland County District court on September 9.

He's being held in the Richland County jail on $250,000 bail.
