Philip Bryson Grimshaw was sentenced on Friday on a charge of sexual intercourse without consent

He was found guilty of the charge in September. 

Grimshaw was sentenced to 40 years in the Montana State Prison; 20 of years are suspended.

On November 21st, 2016, police officers were called to the emergency department at Benefis Health System for a report of a woman who claimed she had been raped.

Officers learned that on November 11th, Grimshaw invited the woman - identified as "Jane Doe" in court documents - to his home for a party.

At some point, Grimshaw reportedly became upset and punched a picture frame, cutting his hand. Doe was able to calm him down and agreed to drive him around, and they went to Doe's residence. 

Later that night, the woman woke up to find that Grimshaw had removed her pants and underwear, and he was raping her. She immediately told him to stop, court records state, but Grimshaw allegedly continued the sexual assault. 

At one point during the attack, Grimshaw reportedly strangled the woman until she blacked out. 

Court documents allege that when Doe woke up later, Grimshaw was still there, and he apologized to her.

He also sent her a text message which read: "I'm sorry about last night. I love you darling. I know you probably never want to talk to me after what happened."

When interviewed by police, Grimshaw admitted forcing Doe to have intercourse with him, even though he knew that she did not want to. He said that he believed his actions constituted rape, and that he was sorry. He also said that Doe's version of what happened "would be the most accurate."
