A Great Falls man was sentenced Wednesday for assaulting a child in 2017.

Johnathan Wayne Teague was sentenced to five years at the Montana State Prison for assault on a minor.

He had originally been charged with sexual assault of a child in August of 2017, but a mistrial was declared in July of 2018.

The trial was reset for February, but the prosecution and defense entered into a plea agreement.

In March, Teague pleaded guilty to the lesser crime of assault on a minor, which carries a maximum of five years in prison.

Judge Greg Pinski said the facts are serious in the case, but with the lesser charge he can only sentence Teague to five years.

(July 31, 2018) The trial of Johnathan Wayne Teague, charged with sexual assault of a child in August of 2017, continued on Tuesday in Great Falls.

On Tuesday morning, Teague’s mother was removed from the courtroom for making comments during some of the prosecution’s testimony.

Cascade County Attorney Josh Racki says the court later learned the mother made a credible threat after she left.

On Tuesday afternoon, both sides presented closing arguments to the jury,

The state says that Teague knew what he did was wrong and convinced the victim to tell people he was sleeping at the time of the incident.

The defense says that Teague had confused the victim with the mother because he was “dead asleep.”

The trial is now in the hands of the jury.
