James David Spagnolo has been charged with four felonies and one misdemeanor after he was allegedly found with heroin and cocaine.
Spagnolo, 39 years old, was arrested Wednesday after a Sheriff’s deputy received a report of a man asleep in a vehicle near Stuckey Road and Golden Valley Loop.
The deputy found Spagnolo slumped over in the passenger seat of the car.
Court documents say that when Spagnolo was woken up, his "eyes were extremely blood-shot and he appeared to be under the influence of an unknown substance."
When the officer searched Spagnolo and the vehicle, he found 24.2 grams of heroin, and 6.2 grams of cocaine, along with several syringes containing brown liquid, three measuring scales with residue, a burnt spoon, and several plastic bags, one of which contained a white powdery substance.
Spagnolo has been charged with the following felonies: two counts of criminal possession of dangerous drugs with intent to distribute; two counts of use or possession of property subject to criminal forfeiture. He is also charged with misdemeanor criminal possession of drug paraphernalia.
Court documents note that at the time of the arrest, Spagnolo was out on conditional release for the underlying offense of felony theft.
Prosecutors requested that bond for Spagnolo be set at $20,000.
